🟠 Main Squeeze: The Fort Pierce wage garnishment dispute is still unresolved and the discussion got pulled from Monday's meeting

If you've been following this story, the planned discussion about charter authority and the roles of Fort Pierce's city manager and city attorney was pulled from Monday night's agenda before it could happen, and the reason was a letter of intent to sue that the city received last week 🏛️.

Why it matters: The item had been placed on the agenda specifically to address the ongoing dispute between the city manager and city attorney that spilled into public view at the April 20th meeting. Commissioners had committed to coming back together to address it. That conversation is now on hold.

What happened Monday 📋:

  • 🔴 The item was pulled from the agenda on a 4 to 1 vote

  • 📄 The commission received a letter of intent to sue last week, which commissioners cited as the reason for pulling the discussion

  • Commissioner Dzadovsky was the lone vote against pulling it, arguing the charter discussion was separate from any pending litigation and needed to happen sooner rather than later

  • 📎 The agenda had included charter documents and both the city manager and city attorney contracts as attachments for the discussion

Commissioner Gaines explained his motion during the meeting: "I don't want anything that could come out of that discussion that could sue the city or hurt the city. As a steward of the taxpayer's money, since we received that letter, this discussion should be pulled until we deal with that lawsuit or potential lawsuit."

Later in commission comments Gaines addressed the public directly: "Please understand that I am not trying to hide this discussion from the public. It will be back on the agenda, but all of us should have the opportunity to hear from whatever attorney has been assigned to this intent."

Although Dzadovsky voted against pulling the item, he later said during commission comments that Gaines' reasoning actually reinforced his original concern about needing an outside legal opinion and said he appreciated the point. "Your position and points made really actually bolster my concerns from the beginning, and that was being able to get an outside opinion on certain matters. I think we have to have that legal opinion outside the current scenario. So I agree with you."

What's next: Gaines said the commission expects to hear from outside counsel this week, and once they do the item should return to a future agenda so the charter discussion can happen with proper legal guidance in place 📅.
